Last May, a federal judge in Dallas sentenced to seven years in prison Otilio Osorio, one of four men accused of smuggling of such weapons.

At trial, federal prosecutors argued that one of weapons purchased and transported by Osorio was used in the murder of Zapata agent.

Smuggling would have been one of the many that were monitored by agents of the Bureau of Alcohol, Snuff, Firearms and Explosives (ATF) under the failed operation “Fast and Furious“.

The operation was designed to track the networks of arms smuggling to Mexico, but to do so allowed hundreds of rifles and handguns were illegally transported to that country.

The claim for wrongful death of Zapata’s family disclosed the same day that President Barack Obama invoked the authority of “executive privilege” to keep confidential documents on “Fast and Furious”.

Executive action occurred while a committee of the House of Representatives declared in contempt of attorney general, Eric Holder, by its refusal to hand over documents relating to the operation.

Zapata, 34, a native of Brownsville, Texas, was killed in February 2011 when in the company of Avila and was surprised by unknown armed men, riding in a van on Highway 57 in the central Mexican state of San Luis Potosi.

During the attack that killed Zapata, Avila was wounded by two bullets in the leg.
